Terms of Service

Welcome to Cuento. The following terms and conditions (the "Terms") govern all use of the Cuento website and all content, services, features, activities, and products available at or through the website (collectively, the "Service"). The Service is owned and operated by Cuento ("the Company", "we", "us", or "our"). The Service is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Cuento's Privacy Policy), and procedures that may be published from time to time by Cuento (collectively, the "Agreement").

Please read this Agreement carefully before accessing or using the Service. By accessing or using any part of the Service, you agree to become bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Service or use any services. If these terms and conditions are considered an offer by Cuento, acceptance is expressly limited to these terms.

1. Acceptance of Terms

By purchasing ad creative packs from Cuento ("the Company"), you ("the Client") agree to comply with and be bound by the following terms and conditions ("Terms of Service"). If you do not agree to these terms, please do not proceed with the purchase.

2. Services Provided

Cuento provides static ad creatives in packs of 5 or 10. Each purchase includes the delivery of ad creatives along with Figma/Canva files. Ad creatives are delivered within 72 hours of receiving the completed intake form.

3. Order Process

To initiate the creation of your ad creatives, you must complete and submit the intake/onboarding form provided by Cuento. Failure to submit this form in a timely manner may result in delays in the delivery of your ad creatives.

4. Revisions

Each delivery of ad creatives comes with 'unlimited' rounds of revisions, within reason. This service is not to be abused. Revisions are intended to ensure client satisfaction, not to place excessive demands on the Company. Cuento reserves the right to limit revisions if requests become unreasonable.

5. Payment

All payments must be made via Stripe checkout link or invoice before any work begins. By making a purchase, you agree to pay the specified amount for the selected pack of ad creatives.

6. Delivery

Ad creatives will be delivered electronically to the email address provided by the Client. Delivery times may vary based on the completeness of the intake form and the number of revisions requested.

7. Client Responsibilities

The Client is responsible for providing accurate and complete information in the intake/onboarding form. Any delays or additional costs resulting from incomplete or inaccurate information will be the responsibility of the Client.

8. Communication

For any questions or concerns, clients are encouraged to reach out to service@trycuento.com. Cuento will make every effort to respond in a timely manner.

9. Intellectual Property and Ownership

All ad creatives provided by Cuento remain the intellectual property of Cuento until full payment is received. Upon payment and delivery of the ad creatives, the Client gains full ownership of the assets.

10. Limitation of Liability

Cuento shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services. Our liability shall be limited to the amount paid by the Client for the ad creatives. Cuento takes no legal responsibility for claims made in the advertising; those fall solely on the Client.

11. Termination

Cuento reserves the right to terminate or suspend service to any Client who breaches these terms or engages in conduct that Cuento deems inappropriate or harmful.

12. Changes to Terms

Cuento reserves the right to modify these Terms of Service at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the new terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Cuento operates, without regard to its conflict of law principles.
